THESE TERMS AND CONDITIONS (“Terms”) set forth important requirements regarding your use of Trinity Infoworks’s computer support services and your relationship with Trinity Infoworks. Please read them carefully, as they contain essential information about your and our rights and obligations regarding the services.
Agreement
Your agreement to these Terms, along with each accepted service plan or order (referred to as “Plan Order”), the Acceptable Use Policy (“AUP”), and the Privacy Policy, together constitute the entire agreement between you and Trinity Infoworks (collectively referred to as the “Agreement”).
If you choose not to submit a Plan Order, the Agreement still includes these Terms, the AUP, and the Privacy Policy.
Definitions

“You” refers to you as an individual or any entity on whose behalf you act.

“Trinity Infoworks” refers to the service provider and includes its affiliates and subsidiaries.

“Services” refers to any service plan offered by Trinity Infoworks that you purchase or subscribe to.

“Materials” include any downloadable content such as white papers, FAQs, product guides, and more. These are proprietary to Trinity Infoworks and/or its suppliers.

“Software” refers to any computer program, either owned by Trinity Infoworks or licensed from a third party.
Plan Orders and Service Plans
You may request Services by placing a Plan Order through our website or by phone. Upon acceptance, we will send confirmation via email. Trinity Infoworks is not obligated to deliver Services for any Plan Order that has not been accepted.
Undertaking
Subject to the Terms and the specific Service Plan, Trinity Infoworks will use commercially reasonable efforts to resolve your issue via phone, chat, email, or remote session, as appropriate. All services are covered under our Limited Warranty described below.
Payment
Services will be provided only after payment has been received in accordance with the applicable Plan Order. No services will be rendered prior to full payment.
Money-Back Guarantee
We offer a money-back guarantee under the following terms:

Subscription Plans: 30-day money-back guarantee from the date of purchase.

One-Time Fix Plans: 30-day money-back guarantee from the date of the first incident.
If you are not fully satisfied, we will make every reasonable effort to resolve the issue. If unsuccessful, you are eligible for a refund within the specified timeframe.
Privacy Policy
The Privacy Policy is incorporated by reference into these Terms. By agreeing to these Terms, you also agree to the Privacy Policy. You acknowledge that any non-personal information shared with Trinity Infoworks is not confidential.
Acceptable Use Policy (AUP)
Your use of Trinity Infoworks Services must comply with our AUP, incorporated herein by reference.
Communication Services
As part of your service, you may be provided access to communication tools such as email, chat, bulletin boards, and forums. These are intended only for communication related to your Plan Order.
Limited License to Use Website, Materials, and Software
You may use Trinity Infoworks’s website, Materials, and Software only as allowed under your Service Plan. Unauthorized use is strictly prohibited.
User Responsibilities
You agree to:

Cooperate with the technician.

Ensure the issue is reproducible on a single system.

Be knowledgeable about your hardware and software.
-
Maintain complete access to the system during sessions.
-
Back up all data before engaging services (Trinity Infoworks is not responsible for data loss).

Keep your account credentials secure and notify us immediately of unauthorized access.
Force Majeure
Trinity Infoworks is not liable for service delays caused by factors beyond its control (e.g., natural disasters, strikes, cyberattacks). We may also suspend services temporarily for maintenance.
Service Exclusions
Services do not include:

Anything not covered by your Plan Order.

Support beyond the plan duration.

Issues outside our control or due to hardware failure.

Software not supported under the plan.
-
Problems caused by misuse, incompatible components, or failure to follow instructions.
Use of Materials and Software
Any downloadable content is subject to the applicable end-user license agreement (EULA). Unauthorized reproduction or redistribution is prohibited.
End-User License Agreements (EULA)
Use of Trinity Infoworks or third-party software is subject to a EULA. You may not install software without accepting the EULA.
Trinity Infoworks Software License
You are granted a revocable, non-exclusive, non-transferable license to use our software in accordance with your Service Plan. You may not:

Copy, modify, or distribute the software.

Reverse-engineer or decompile it.
-
Remove copyright or trademark notices.
All rights remain with Trinity Infoworks or its licensors.
Third-Party Software and Services
If we assist you with third-party software, you are responsible for complying with that vendor’s license terms. Trinity Infoworks does not warrant third-party products or act as a reseller. Using unauthorized support may void warranties from those vendors.
Limited Service Warranty
All services, materials, and software are provided "as is" with no warranties, express or implied. Your sole remedy is to:

Allow us to re-perform the service, or
-
Reinstall the software.
No liability will exceed the amount paid under the applicable Plan Order.
Limitation of Liability
Trinity Infoworks is not liable for any indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid for the disputed Plan Order.
Limitation on Actions
Any claim must be brought within one (1) year of the incident, or it is waived.
Termination
We may suspend or terminate your service if:

You breach any of these Terms.

Your use violates laws or disrupts our network.

We receive a court order.

We cease offering the service.

You are no longer a customer.

You abuse the service.
Trinity Infoworks reserves the right to refuse service or re-subscription at its discretion.
Severability and Waiver
If any part of these Terms is held invalid, the rest will remain enforceable. Our failure to enforce a provision is not a waiver of that right.
No Offer
Reference to services in other countries does not imply we offer them there. Availability is limited by jurisdiction.
Modifications
We may update these Terms at any time by posting on our website or notifying you via email. Continued use of the service constitutes acceptance of the updated Terms.
Governing Law
This Agreement shall be governed by the laws of the State of Florida, without regard to conflict of laws principles.
Arbitration
Any dispute shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996 in Broward County, Florida, in English.
Customer Warranties
You warrant that:

You genuinely need the services and are not a competitor.

You are authorized to request services on the system in question.

You will not introduce malware into our systems.

There is no illegal content (including child pornography) on your system. If this is untrue, you forfeit any expectation of privacy and may be subject to legal reporting.
